I also had two LUD's after I submitted the AR-11 form. It took two days more after I submitted the AR-11 form

I also got LUD once I have submitted AR 11 but I only has LUD on my I765, I131 not on I485, But I did received confirmation from USCIS that my address got changed for pending App (i.e. 485)..Should I be worried...since I didnt get any LUD on 485....Please help

Nah you are right, that is all I did, but I honestly doubt anyone would make a fuss :) I mainly made them for the sake of it, the only ones I'd definately want to see on there are the first 2 anyway so you can take the others off if ya don't want them :)

Yes. UR Lawyer is correct. U have to just pay one single fee for 485 filing and u can file yearly extensions for EAD and AP Free till ur 485 is approved.

The only catch is that it might raise a suspicion if a person entered in H-4 status and immediately filed to change to H-1B, say within a couple of days. A difficult CIS officer might consider that this meant that the person entered by misrepresenting their true intention. However, given that there is a cap and the person couldn't start on H-1B until 10/1 anyway, that should be OK.

I am observing the alerts and discussions here and also the current political activities.Such a pity that we dont mean anything compared to those who broke the law to enter here.
Anyways we are part of this system and have to keep fighting till we go down.
I have a suggestion: Can we make a online petition focussing clearly on just eb provisions in the bill coming to the floor . We can make immigration voice as the sender and send to only senate judiciary committee members .
We should also let them know that our community is closely following senate proceddings and actvities and would request to know their stand on our plight. I dont think those guys know we exist for one or second we r watching them close.Why would they talk of us if they dont know we r watching..
we should ask them for answer:do u want us to leave now as its not possible for a eb3 indian to stay on in one job for years waiting for gc. or do u really want tohelp us out.
i think a single petiition with thousands of signs would be better right now as time is limited. any thoughts..if u guys approve we have to work real fast on it.

Simple answer is there is no such thing as a temprorary EAD. There used to be but they were eliminated some years ago.
You will just have to wait and hope. If however, the processing time exceeds 90 days you can take an infopass appointment and the local office will contact the service center to get things rolling.

I recently received an inquiry at my San Francisco immigration law office from an "employer" who recently discovered that a person whom he had hired as an independent contractor was in the United States illegally. The employer had not originally known that the "employee" was illegal because independent contractors are exempt from the requirements of the Immigration Reform and Control Act (*IRCA*) (https://www.oig.lsc.gov/legis/irca86.htm) that require an employer to verify that an an employee is authorized to work in the United States. The "employer" wanted to explore the options of legalizing the contractor. While thinking about the options, I became interested in how the law defines an independent contractor.
According to 8 Code of Federal Regulations Section 274a.1(j) (http://www.californiaimmigrationlawyerblog.com/8cfr274a.1.pdf) an independent contractor is an individual or entity who carries on an independent business, contracts to do a piece of work according to their own means and methods, and are subject to control only as to results.
The decision of whether or not someone is an independent contractor is determined on a case-by-case basis. Factors to be considered include whether the individual or entity:
supplies the tools or materials;
makes services available to the general public;
works for a number of clients at the same time;
has an opportunity for profit or loss as a result of labor or services provided;
invests in the facilities for work;
directs the order or sequence in which the work is to be done and determines the hours during which the work is to be done.
I began to wonder if people used independent contractors to get around the IRCA requirements. I hope you realise this is a serious issue. You need to find out from your employer who filed your H1 whether he filed it as a "Change of Status" (COS) petition or "Visa to be issued abroad category".
If it was a H1 COS petition, then you have been accruing unlawful H1 status since your H1 start date as your status automatically changed from H4 to H1 (assuming your approval came with an attached I-94). In this case, you need to get back to H4 status. You can do that by re-entering US on a valid H4 visa (preffered way) or by filing a new H1 to H4 COS petition.
If your H1 petition was not filed under COS (filed under Visa to be issued abroad category), then you are still on H4 status (assuming you have been maintaining a valid H4) and there is nothing you need to do. If you want to convert to H1, then you need to go to a consulate mentioned on your H1 application, attend the H1 interview and re-enter US using H1 stamp.
Hope this helps and you take the necessary action.
