I have received my green card 5 months ago and still working for the same GC filing employer(a consulting company). My wife had an RFE on her GC, since she could not take MMR at 2007 fiasco time. We have recently replied with the evidence. Now my project is getting over at the client site in next couple of weeks. I am sure that I can lose my job at consulting company also.
My question is, what happens to wife's GC? What if there is another RFE and how can I reply it?
Please let me know my options.

I know this is irrelevant in a way but see it from a different angle for one moment. There is no other forum where you can get any information about these H1 employers who are playing games using retrogression. This is the only forum where most of the people on H1 are related to some desi consulting company and can share their experiences which would help other people who are in huge pain due to the unfair practices of their existing employers.
I would recommend the administrators to create a separate area on this forum where people can share these experiences and find genuine employers.

I went through the same and it was fairly easy and not stressing.. you have to have copies of your passport ( the persons applying for extension and copies of the return tickets of the flights back home, you need a form : I-539 and fill it up, print it and send it with all the documentation they require, it would be advisable to have a sponsor or a person who certifies that will be financially in care of her expenses. ( forgot the form number but i think is I-139 ..please check ) and once you got all those requirements send them with 300 $ that costs the application process and in less then 4 weeks you will get a letter with either the aproval or the denial of the stay. If your I-94 expires while you wait for the form do not worry cause you are not going into illegal state while the USICIS is processing your application. GOOD LUCK !! and enjoy your ceremony !!

I'm wondering if there are any successful cases where CSPA and the Patriot Act were combined to ensure that the child remains under 21? My son's name has been deleted from the derivative beneficiary's list, however, he can remain eligible under this F-4 petition if the Consular calculate his age with Patriot Act 45 days. In that case, he can benefit from CSPA. Our case details as below:

For all the folks who have done FP and have received their EADs, did anyone ofyou got any LUDS on your AP case since the receitp date. If so, please let us know how many LUDS and how often you go them.

If your future wife is not in the US now, she will apply directly at the consulate for her L-2 visa. There is no need for you or her to get prior approval from CIS, like you do for the L-1. Your question is unclear, so I don't know if this answers it.

Hi,
This is my first post here. I was looking for "Experience Letter Format" that Is needed for filing I-140. I have not started my GC yet but was looking for all the documents required. It seems to be a nice idea to get all the experience letters from the previous employers before starting labor process.
If some one has the format currently required by USCIS, please post it.

Hi,
I did H1B Transfer from Company A to Company B on 12/07/09. But after 2 RFEs, my H1B got denied with Company B (for employer-employee relationship issue even though my company B is direct Vendor with current Client) on 04/22/10. I'll reapply appreciate if you can help me with following questions:
1) Am I out of status from now? If not, when will I go out of status? Is there any grace period do I get for stay in US after denial?
2) Does appeal / motion to re-open (MTR) put me back in status or allow me to continue working at client site till appeal is resolved? What if the appeal is rejected? I'll be out of status from the date when H1B was denied. Am I correct?
3) Is it possible to re-apply for H1B transfer (with Company B or with any other Company) after denial and continue working at client site (without leaving the country) or I need to leave Country till new H1B transfer application gets approved?
5) I have approved H1B & I94 from my previous Company A valid till 10/30/2011. Also I have approved H1B from Company D (for which I never worked so far) valid for another 1 year. Both these H1B status is showing Active on USCIS website. So is it possible to work with any of the Company C or D without any h1B transfer? You ve 2 options:
a. Apply COS from H1 to L1 an H4 to L2. But I am not sure whether you can revert back to H1 at a later date.
b. Exit USA an re-enter using valid L1/L2 visa.

Hi,
I am currently working on a fulltime H1B and my GC process is going on with second stage (I140) in progress. Now my old employer wants me to work parttime for them which I agreed upon but this is a possibility only if I have a parttime H1B applied w.r.t old employer which I am thinking to apply for it and work parttime. But my question here is does this effect my GC processing? If it is what are the effects? Please reply me back. Thanks a lot.

My EB3 AOS was filed in July, 2007.
I have a valid H1 upto July, 2010 and my EAD expires September, 2010.
My wife and daughter have valid H4 upto July, 2010 and their EAD expires September, 2010. Both have used EAD.
APs are expiring in July 2010 for all of us.
My employer has filed for H1 extension.
I have couple of questions regarding my family�s statuses;
1. If my wife and daughter do not want to renew their EADs/APs (or renewal gets delayed beyond September, 2010), what is their legal status in US as they don�t have a valid I-94?
2. As they already used EADs, I think they are not eligible for H4 filing. Can someone confirm?
3. Does anyone have experience of renewing Driving license without EAD or H4 during AOS?

Does emotional trauma and endless domestic disturbance of peace caused by years of waiting for the Priority dates to be current count?
Also who has to be the perpetrator of the severe violence? If an H1B beats up another H1B does that count? Or it only counts if a Citizen or GC holder beats u up? Now this is an important piece of information so that I know whom to ask to beat me up!!;)

hello, I am in a F1 status for about 3 years, I have been working and filing taxes. I am going to get married to a USC and apply for a green card through it. I want to know if I can have any problem in the aplication since I've been working without authorization.

I believe she can continue to work if she files H1 extension and has a receipt notice. But if you are pursueing the EAD angle you will need an EAD card in hand physically to go that route. In a way its good that your employer is supporting the EAD efforts but that also takes longer because of documents and information exchanges with the attorney etc. Hope this helps
